These Terms and Conditions ("Terms") govern your use of the services provided by $99 Websites ("we", "us", "our"). By engaging our services, you agree to be bound by these Terms. Please read them carefully.

1. About Us

$99 Websites is an Australian owned and operated business providing website design, development, and hosting services. We are based in Sydney, New South Wales, Australia. For enquiries, contact us at support@99websites.com.au.

2. Our Services

For $99 per month (excluding GST), we provide:

We offer a range of website styles including single-page scroll-based sites and traditional multi-page websites. We do not build e-commerce stores or websites with inbuilt booking or reservation systems. If your requirements fall outside what we offer as a $99 Website, we will advise you upfront before any work commences.

3. Pricing & GST

All prices are quoted in Australian dollars (AUD) and are exclusive of GST. GST of 10% will be added to all invoices in accordance with Australian tax law. The monthly subscription fee is $99 + GST = $108.90 per month.

4. Billing & Payment

Your first payment is due upon your written acceptance of the initial website draft. Subsequent payments are billed monthly on the same date. Payments are processed securely via Stripe. Our preferred payment method is direct debit (BECS), though card payments are also accepted.

If a payment fails, we will notify you and attempt to collect the outstanding amount. We reserve the right to suspend or take down your website if payment remains outstanding after 14 days.

5. Website Delivery

We aim to deliver your initial website draft within 2–3 business days of receiving all required information from you. Delivery times may vary depending on the complexity of your requirements or the volume of current work. We will advise you if delays are expected.

6. Revisions & Ongoing Changes

Your subscription includes ongoing changes within reason. This covers minor content updates, text changes, image swaps, and small layout adjustments. Requests that amount to a full redesign or rebuild may be treated as a new project at our discretion.

Change requests should be submitted via email to support@99websites.com.au. We aim to complete changes within two business days, unless we advise otherwise due to volume or complexity.

7. Cancellation

There are no contracts or minimum terms. You may cancel your subscription at any time by emailing support@99websites.com.au with 30 days notice. Your website will remain live until the end of your final billing period, after which it will be taken down.

We reserve the right to cancel or suspend services at our discretion with reasonable notice, including in cases of non-payment, misuse, or breach of these Terms.

8. Domain Names

Domain name registration and renewal costs are not included in the $99/month subscription and will be passed through to you at cost with no markup. If you already own a domain, you will need to provide us with temporary access to your domain settings in order to connect it to your website. You retain full ownership of your domain at all times.

9. Intellectual Property

Upon receipt of your first payment, ownership of the website design and content we create for you transfers to you. We retain the right to display your website in our portfolio unless you request otherwise in writing.

You are responsible for ensuring that any content, images, or materials you provide to us do not infringe the intellectual property rights of any third party.

11. Limitation of Liability

To the maximum extent permitted by Australian law, $99 Websites will not be liable for any indirect, incidental, special, or consequential loss or damage arising from your use of our services, including but not limited to loss of revenue, loss of data, or business interruption.

Our total liability to you for any claim arising from our services will not exceed the total amount paid by you in the three months prior to the claim.

12. Warranties

We warrant that our services will be provided with reasonable care and skill. We do not guarantee specific outcomes such as search engine rankings, website traffic, or business results.

13. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of New South Wales.

14. Changes to These Terms

We may update these Terms from time to time. We will notify existing customers of material changes via email. Continued use of our services after changes take effect constitutes your acceptance of the updated Terms.
